Terms of Service — Barzil.ai

Welcome to Barzil.ai. The Service is operated by Zohar Barzilai, registered in Israel ("Barzil.ai", "we", "us", or "our"). These Terms of Service ("Terms") govern your access to and use of the Barzil.ai website, web application, API, and any plugins or digital audio workstation (DAW) extensions we make available, and our related AI audio generation and transformation tools (collectively, the "Service").
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. The Service and Underlying Models
1.1 What the Service Does
Barzil.ai transforms drum audio. It works from a rhythmic reference that you supply, in one of two ways:
- Create Mode: you sequence a drum pattern in the browser and the model performs it.
- Transform Mode: you upload audio or video containing drums and the model reproduces the timing and pattern with different sound and performance characteristics.
What the Service does not do: the model does not compose drum parts where no rhythmic reference exists. It will not write a drum track for a recording that contains no drums and no sequenced pattern. Your timing and pattern remain the foundation of the output; the model adds performance detail such as dynamics, ghost notes, cymbals and room character, and may add rhythmic detail that was not present in your input.
The Service is a creative tool and instrument for musicians, producers and creators. It is not a replacement for human artists.
1.2 Underlying Models
Our primary model is a custom fine-tuned derivative of Stable Audio Open 1.0, created by Stability AI. The base model was trained by Stability AI on approximately 486,000 Creative Commons–licensed recordings from Freesound and the Free Music Archive, licensed under CC0, CC BY or CC Sampling+. We then fine-tuned it on original drum recordings performed and recorded in-studio by Zohar Barzilai. We do not use scraped samples, commercial recordings, or third-party sample libraries in our fine-tuning, and we do not train on user-uploaded content.
We may update, replace or modify the models powering the Service at our discretion. Model updates do not require notice to you unless they materially change your rights under these Terms.
Barzil.ai is an independent service. Trademarks belonging to third-party model providers (including "Stability AI" and "Stable Audio") are referenced solely to describe the underlying model architecture and do not imply affiliation or endorsement.
1.3 Model Licensing — Our Responsibility, Not Yours
You do not need your own licence from Stability AI to use the Service or to use your Outputs commercially. Barzil.ai holds the licence for the underlying model and is responsible for complying with it, including any registration, attribution and revenue-threshold obligations that licence imposes on us. There is no revenue cap on your use of your Outputs under these Terms.
We display the attribution notice required by the underlying model licence on this website. You are not required to reproduce that notice, credit Stability AI, or credit Barzil.ai when you distribute your Outputs.
This allocation applies to your use of the Service as we provide it. If you separately obtain, download, fine-tune or redistribute Stability AI models yourself, that activity is governed by your own agreement with Stability AI and falls outside these Terms.
2. Eligibility and Accounts
You may use the Service only if you are at least 18 years old (or the age of majority in your jurisdiction) and have the legal capacity to enter into a binding agreement.
If you create an account, you must provide accurate information and keep it up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You may create or access your account using email or a third-party login provider (such as Google or Facebook/Meta); when you use a third-party login, that provider's terms also apply.
2.1 Changes to the Service
We may add, change, or remove features of the Service over time. Where we remove or materially reduce a feature you rely on, we will give reasonable notice through the Service or by email. Section 9 covers changes to these Terms, and Section 3.5 covers what happens if we discontinue the Service entirely.
The Service depends on third-party infrastructure and may be unavailable during maintenance or outages. We do not guarantee any particular level of uptime.
2.2 Beta Features
Some features are marked "beta" or similar. They are experimental, provided as-is, may behave unpredictably, and may be changed or withdrawn at any time without notice. Where a beta feature consumes credits, we will replace credits lost to a beta feature failing, on the same basis as Section 3.4.
3. Credits, Purchases, Refunds and Withdrawal
3.1 How Credits Work
Barzil.ai uses a credit-based system. There is no subscription. Each generation request consumes credits based on factors such as audio duration and mode; one credit is approximately sixty seconds of processed drums. The system may pre-authorise an estimated credit cost, but credits are only deducted on successful completion of your request.
Credits do not expire while your account remains open. Credits have no cash value, are not transferable between accounts, and cannot be exchanged for money except as set out in this Section 3 or as required by applicable law.
Inactive accounts. We will not delete an account holding unused credits for inactivity alone without first emailing the address on the account and allowing at least thirty days to respond.
3.2 Who You Buy From
Credit packs are sold to you by Gumroad, not by us. Gumroad acts as our authorised reseller and as merchant of record for each sale. Your purchase contract for the credits is with Gumroad, and Gumroad is responsible for pricing at checkout, invoicing, payment processing, and collecting and remitting applicable VAT, GST and sales tax.
Your purchase is therefore subject to Gumroad's terms as well as these Terms. Once a credit pack is purchased, the licence key unlocks a credit balance in your Barzil.ai account, and these Terms govern the Service itself — your account, how credits are redeemed, what you get back, and what you may do with it.
Promotional credit grants, including sign-up credits, come directly from us, are discretionary, and may change or end at any time.
3.3 Refunds, Withdrawal and Consumer Rights
Because Gumroad is the seller of record, statutory consumer rights relating to the purchase — including the fourteen-day right of withdrawal available to consumers in the EU and UK, and the withdrawal mechanism required at checkout — are exercised against Gumroad, under Gumroad's terms and through Gumroad's checkout and support process.
We will not use that structure to avoid helping you. If you have a problem with a purchase, email support@barzil.ai and we will either resolve it directly where we can, or take it up with Gumroad on your behalf and stay involved until it is settled.
Nothing in these Terms limits any mandatory consumer right you have under the law of your country of residence, against us or against Gumroad.
3.4 Failed Generations
Generative models are non-deterministic and generations can occasionally fail through system errors, timeouts, or severely degraded output. In those cases we will, on review, issue replacement credits. Credits are not refunded for Outputs that generate successfully but do not meet your subjective artistic expectations. This credit-replacement commitment is ours and is separate from, and in addition to, any consumer right you have against Gumroad under Section 3.3.
3.5 If We Discontinue the Service
If we permanently discontinue the Service, we will give at least thirty days' notice by email to registered account holders, and we will refund the value of any unused credits on a pro rata basis using the price you paid for them, arranged through Gumroad or paid directly, whichever is workable at the time. You should download and back up your Outputs before the notice period ends.
4. Ownership and Intellectual Property
4.1 Your Inputs
"Inputs" means any audio, video, MIDI, sequenced patterns, text or other content you upload or provide to the Service. You retain all rights in your Inputs. We take no licence in your Inputs beyond what is technically necessary to process your request and return your Output.
By submitting Inputs, you represent and warrant that you own or have all necessary rights to use them and to have us process them, and that they do not infringe any third-party rights. If audio came to you from another service or platform, its terms may restrict what you can do with it; checking that is your responsibility, not ours.
4.2 Outputs
"Outputs" means any audio or other content generated or transformed by the Service in response to your Inputs.
Subject to your compliance with these Terms and to any rights in your Inputs or third-party material, we assign to you all right, title and interest that we hold in your Outputs. We claim no ownership over them and require no attribution. You may use them in commercial releases, videos, podcasts, games, client work and anything else lawful.
Copyright disclaimer. Under current intellectual property law in many jurisdictions (including the US and EU), purely machine-generated content may not be eligible for copyright protection and may fall into the public domain. We assign what we hold, but we make no representation or warranty that copyright will vest in any Output. Whether your own human contribution amounts to sufficient authorship is a question you must assess for yourself.
Outputs may not be unique. Because of how the model works, another user submitting a similar pattern or similar audio may receive a similar or substantially identical Output. Outputs generated for other users are not your Outputs, and we cannot guarantee that any Output is unique or free of similarity to existing works.
4.3 Restrictions on Training
You may not use Outputs to train, fine-tune or otherwise develop any generative AI model, or to build a product or service that competes with the Service. This includes assembling Outputs into datasets for that purpose.
This restriction is not only ours. The licence governing the underlying model treats a model derived from that model's output — including fine-tunes and LoRAs — as a derivative work subject to that licence in its own right, and separately prohibits using outputs to create or improve foundational generative AI models. If you train anything on Outputs, you take on direct obligations to the upstream licensor and step outside the protection described in Section 1.3.
5. Data Privacy and the "No Training" Guarantee
5.1 We Do Not Train on Your Content
We do not use your Inputs or Outputs to retrain, fine-tune or otherwise improve our AI models. We do not take a licence in your music, we do not make your content available to other users, and we do not require you to waive any moral rights. We log non-identifying operational metrics such as error rates and request durations for performance monitoring; your audio and prompts are never fed into a training pipeline.
5.2 Temporary Processing
Uploaded content is retained only to generate Outputs and operate the Service, and is automatically purged from active systems within a short window (typically under 72 hours). We are not an archival storage provider; you are responsible for keeping local backups of your Inputs and Outputs. Our Privacy Policy describes our data handling in full.
6. Acceptable Use and Prohibited Conduct
Your use of the Service must comply with applicable law and with the Stability AI Acceptable Use Policy, which the underlying model licence incorporates and which therefore applies to your use of the Service.
To protect artists, rights-holders and public safety, you agree not to use the Service to generate, upload or disseminate:
- Child Exploitation (CSAM): Content that targets, depicts, or sexually exploits minors. We maintain a zero-tolerance policy and will report such activity to the relevant authorities.
- Terrorism & Violent Extremism: Content promoting, glorifying, or providing instructions for terrorist acts or mass violence.
- Hate Speech & Harassment: Audio that abuses, demeans, defames, or incites violence against protected classes based on race, religion, gender, or sexuality.
- Fraud & Deceptive Practices: Impersonation, cloning for financial scams, or generating intentionally misleading broadcasts.
- Artist Cloning: Intentionally recreating the recognisable drum patterns, signature sound, or sonic identity of a specific human artist in a way likely to cause confusion or violate rights of publicity.
- Self-Harm: Content that promotes, encourages, or provides instructions for self-harm or suicide.
- IP Infringement: Commercial songs, stems, or datasets you do not own or are not licensed to use.
- Spam & Abuse: Using automated bots or scraping to mass-generate content or exhaust server resources.
We may investigate suspected violations and suspend, restrict, or terminate access without refund where a violation is established.
7. Copyright Complaints
7.1 Designated Agent

7.2 Filing a Notice
To be effective, a notice must include: (a) a physical or electronic signature of a person authorised to act for the copyright owner; (b) identification of the copyrighted work claimed to be infringed; (c) identification of the material claimed to be infringing and where it is located, in enough detail for us to find it; (d) your address, telephone number and email address; (e) a statement that you have a good-faith belief the use is not authorised by the copyright owner, its agent, or the law; and (f) a statement, under penalty of perjury, that the information is accurate and that you are authorised to act on behalf of the copyright owner.
7.3 Counter-Notification
If your material was removed or disabled and you believe this was a mistake or misidentification, or that you are authorised to use it, you may send a counter-notification to the agent above containing: (a) your physical or electronic signature; (b) identification of the material and its location before removal; (c) a statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification; and (d) your name, address, telephone number and email address, a statement that you consent to the jurisdiction of the federal court for the district in which you live (or, if outside the United States, any judicial district in which we may be found), and a statement that you will accept service of process from the party who filed the original notice.
We will forward a counter-notification to the original complainant and may restore the material within ten to fourteen business days unless the complainant notifies us that they have filed an action seeking a court order.
7.4 Repeat Infringer Policy
We have adopted and will reasonably implement a policy of terminating, in appropriate circumstances, the accounts of users who are repeat infringers. In general, an account that is the subject of a second valid, uncontested notice of infringement will be suspended, and an account subject to a third will be terminated. We may also terminate an account at any time where the circumstances warrant it, whether or not there has been repeat infringement, and may limit access to the Service in the meantime.
8. Disclaimers and Limitation of Liability
8.1 Disclaimers
The Service (including all audio outputs) is provided on an "As Is" and "As Available" basis, without warranties of any kind, whether express, implied, or statutory.
To the maximum extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free, that any Output will meet your requirements, that Outputs will be free from similarity to existing works, or that Outputs will qualify for copyright protection.
8.2 Limitation of Liability
Barzil.ai will not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total aggregate liability will not exceed the greater of the amounts you paid to us in the 12 months prior to the claim, or USD $50.
8.3 Indemnification
You agree to indemnify, defend, and hold harmless Barzil.ai and its affiliates, directors, officers, employees, and agents from any claims, damages, losses, liabilities, costs and expenses (including reasonable legal fees) arising from: (a) your use of and access to the Service; (b) your violation of these Terms; (c) your violation of any third-party right, including any copyright, property, or privacy right; or (d) any claim that your Inputs caused damage to a third party.
8.4 Statutory Rights
Nothing in these Terms excludes or limits any liability or right that cannot be excluded or limited under applicable law, including your statutory rights as a consumer and liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.
9. Changes to These Terms
We may update these Terms from time to time. We will post the revised version on this page and update the "Last updated" date at the top.
Where a change is material — for example, a change to pricing mechanics, ownership of Outputs, the no-training guarantee, or dispute resolution — we will give you notice at least thirty days before it takes effect, by email to your registered address or through a prominent in-service notice. If you do not agree to a material change, you may close your account before it takes effect and request a pro rata refund of unused credits on the basis described in Section 3.5. Continued use of the Service after a change takes effect constitutes acceptance.
10. Dispute Resolution and Governing Law
Before starting formal proceedings, please contact us at legal@barzil.ai. Most issues are resolved quickly. If we cannot resolve a dispute within sixty days, the following applies based on where you live:
A. United States Users (Arbitration & Class Action Waiver)
If you reside in the United States, disputes arising out of these Terms will be resolved by binding, individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, except that either party may bring qualifying claims in small claims court. You and Barzil.ai waive the right to a trial by jury and to participate in a class, mass, or representative proceeding. The Federal Arbitration Act applies.
Opt-Out: You may opt out of arbitration within 30 days of first accepting these Terms by emailing legal@barzil.ai with your name and a statement that you wish to opt out. Opting out does not affect any other provision of these Terms.
B. European Union, UK, and Consumer Users
Consumers in the EU, UK, or other jurisdictions with mandatory consumer protections retain all statutory rights, and may bring proceedings in the courts of their place of residence. Nothing in this section deprives you of the protection of mandatory provisions of the law of your country of residence.
C. Users in Israel and the Rest of the World
For users residing in Israel or any jurisdiction not covered above, these Terms are governed by the laws of the State of Israel, and disputes are subject to the exclusive jurisdiction of the competent courts in the Central District of Israel.
Time limit. Except where applicable law provides otherwise, any claim arising out of these Terms or your use of the Service must be brought within one year after the claim arose.
11. General Provisions
- Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Barzil.ai regarding the Service and supersede any prior agreements.
- Severability: If any provision is held invalid or unenforceable, it will be struck and the remaining provisions will continue in force.
- No Waiver: Our failure to enforce any provision is not a waiver of our right to enforce it later.
- Assignment: You may not assign these Terms without our prior written consent. We may assign or transfer them, in whole or in part, including in connection with a merger, acquisition, or sale of assets, on notice to you.
- Force Majeure: We are not in default for any failure or delay caused by circumstances beyond our reasonable control, including war, hostilities, natural disaster, epidemic, sabotage, or the unavailability of electrical power, network access, or third-party compute infrastructure.
- Notices: We may give you notice by email to your registered address or through the Service. You may give us notice at the addresses below.
